LTC Home Health Care Minimums (F.S. 627.94071)
Definition
An LTC policy containing a home health care benefit may NOT: condition benefits on an acute condition before home care is needed; limit home care to conditions that would otherwise require skilled nursing facility care; require nursing or therapeutic services in the home first; require providers to hold more certification or licensure than the service needs; limit benefits to Medicare-certified agencies or providers; exclude personal care by a home health aide; or exclude adult daycare services.

If the policy says "home care," it must mean real home care — aides, adult daycare and all — without smuggling nursing-home-level tests back in.
