Unfair Discrimination (Florida)

Definition
Prohibited acts include: unfair discrimination between individuals of the same actuarially supportable class and equal expectation of life in rates, dividends, benefits, or terms of a life insurance or annuity contract; between individuals of the same class and essentially the same hazard for health/disability insurance; underwriting or claim actions based on a person having sought treatment or protection for abuse (insurers may consider a medical condition itself, but not that abuse caused it); and, for personal lines property/auto insurers, refusing, canceling, surcharging, or disclosing based on lawful firearm or ammunition ownership.
In plain English
Same risk class, same deal. Being an abuse survivor or a lawful gun owner is not a rating factor.
Exam tip
The lawful kind of discrimination — different rates for genuinely different risk classes — is actuarial and fine. "Unfair" means within the same class.
