Privacy Notice & HIV Consent
Definition
An agent taking an application that captures personal financial or health information must give the applicant a privacy notice — for life insurance this comes from Gramm-Leach-Bliley, implemented in Florida at F.S. 626.9651 and Rule 69O-128 F.A.C. (life insurers are not HIPAA covered entities; life is an "excepted benefit" under 45 CFR 160.103). Separately, any blood test for HIV requires the applicant's signed, informed HIV consent disclosing the insurer's intent to test (F.S. 627.429).
Exam tip
⚠️ Trap: the privacy notice a life agent hands over is a GLBA notice, not HIPAA. HIPAA governs health plans — ch 15 territory.
