Health · Chapter 18 · Additional Provisions
No Loss / No Gain Statutes
Definition
When one health policy replaces another, no-loss/no-gain laws make the new insurer pick up claims already in progress under the old policy — coverage carries over exactly: the insured loses nothing and gains nothing on an ongoing claim.
In plain English
Switch policies mid-claim and the new company inherits the claim as-is — no coverage gap, no benefit upgrade.
