Rebating (Florida)

Definition
Unless expressly allowed by law, knowingly: making any contract or agreement other than as plainly expressed in the issued contract; paying or offering any rebate of premiums, special favor or advantage in dividends/benefits, or any valuable consideration or inducement not specified in the contract; or giving/selling/purchasing stocks, bonds, securities, or dividends as an inducement to purchase insurance. EXCEPTION: promotional items and gifts are NOT an unlawful rebate as long as the value does not exceed $100.

Sweetening the deal with anything the contract doesn't promise — cash back, gifts, securities — is rebating. Swag under $100 is the one safe harbor.
Exam tip
⚠️ The $100 promotional-gift exception is Florida's twist — a $75 gift card is legal; a $150 one is rebating. Offering to split your commission is the classic rebate scenario.
