Small Employer Definitions (F.S. 627.6699)

Definition
The Florida Employee Health Care Access Act promotes coverage availability to small employers regardless of claims experience or employee health status. Definitions: small employer = a business actively engaged in Florida (principal place of business here) with at least one (1) but not more than fifty (50) eligible employees, the majority employed in Florida. Eligible employee = works full time with a normal workweek of at least 25 hours and has met waiting-period requirements — including a sole proprietor, partner, or independent contractor included under the plan, but NEVER part-time, temporary, or substitute workers. Guaranteed-issue basis = the policy must be offered regardless of health status, preexisting conditions, or claims history. Late enrollee = enrolls outside the initial or a special enrollment period. Modified community rating = community rating plus separate factors for age, gender, family composition, and tobacco use (the note's definition also allows adjustments for claims experience, health status, and duration of coverage; the Rating Act paragraph lists geographic area — see the flag at the top of this file).
