Health · Chapter 19 · Underwriting Laws

Genetic Information Nondiscrimination Act (GINA)

Definition
Federal law (2008) protecting Americans against discrimination based on genetic information when applying for health insurance. Insurers cannot use genetic testing to gather underwriting information.
In plain English
Your DNA is off-limits to the health underwriter.
Exam tip
GINA covers HEALTH insurance and employment only — life, disability income, and LTC underwriting are NOT covered by GINA. A genuinely testable distinction.
