Advertising Rules (Approval & Identification)
Definition
An agent may use advertising pertaining to an insurer's business ONLY with the insurer's approval — prior written approval, or prior oral approval with subsequent written confirmation (F.A.C. 69B-150.013(10)). All advertising materials and communications about insurance products must clearly indicate they are insurance advertisements — the insurance nature can never be hidden (F.S. 626.9531). When soliciting or selling, agents must clearly indicate they are acting as insurance agents with regard to insurance products and identified insurers.
