Incontestable Clause

Definition
After the policy is in force 2 years, the insurer can no longer contest or void it — even for fraud, material misstatement, or concealment.
Exam tip
Two lists. Statutory (F.S. 627.455): the 2-year bar does NOT cover nonpayment of premium, and — at the insurer's option — disability and accidental-death riders stay contestable. Case-law/exam convention: contest ANYTIME for impersonation/fraudulent identity, no insurable interest at issue, or intent to murder. Exclusions (suicide, war, aviation) can also be raised at any time (F.S. 627.463). Don't confuse with the suicide clause (also 2 years).
